La licence Apple Public Source licence (APSL) est la licence sous laquelle la firme distribue son Projet Darwin.

Intérêt de la licence

Le choix de l'open source permet d'intégrer la communauté du Libre dans l'évolution du projet (par la même occasion, Mac OS X profite de ces contributions). La licence est propre à la firme Apple et n'est pas forcément conseillée pour la formation d'autres projets.

Historique de la licence

En 1999, la première version de la licence fut rejetée en bloc par la FSF et l'OSI, donnant naissance à la APSL v. 1.2, en janvier 2001, qui reçut le label open source. Les changements majeurs concernent la clause 2.2c qui imposait à tout contributeur d'avertir Apple de ses modifications apportées au Code Source.

C'est la FSF qui fut la plus hésitante à qualifier de libre l'APSL, les principaux reproches portaient : sur l'enclenchement automatique de la licence qui constitue une sorte d'immixtion dans la vie privée (et une extension du pouvoir du titulaire de droit), ou du moins le travail à titre privé, du licencié ; la transmission obligatoire de la version modifiée à Apple lors de chaque communication au public ; une clause de terminaison des droits trop protectrice des intérêts d'Apple. La critique portait aussi sur l'intention, et le contexte de la licence, plus conforme aux idées de l'open source que du Libre.

Section 2.2(c) of the APSL requires that the producer of modifications to APSL-licensed code use a particular URL in the Apple.com domain to notify Apple. While the demise of Apple Computer, Inc. is unlikely in the near future, that sad event would leave us unable to comply with this section of the APSL. This would constitute a restriction on all rights granted by the license, including those rights necessary to qualify under the Open Source Definition. The Free Software community plans a very long lifetime for its software, and we hope that Apple will cooperate by changing this provision so that APSL-licensed software could survive without Apple. We suggest that the simple publication of modifications, such as posting on a personal web site accessible to the global internet and pointed out in any binary distributions, be all that is required. This is consistent with other licenses in our community.

Section 9.1 of the APSL allows Apple to terminate our rights to use any or all APSL-covered code, at its sole discretion, in the event of an unproven claim of infringement, no matter how specious. This is derived from a similar objectionable portion of IBM's Jikes license, which disqualified that license from being referred to as "Open Source". We hope that Apple will consider the investment that members of the Free Software community will put into APSL-licensed code when they write modifications for it. An arbitrary termination could cause us to suddenly lose that investment at some future date, with no chance for appeal. The licenses accepted by our community do not provide the possibility of termination in this manner. If termination due to an infringement claim is to be allowed at all, it should be explicitly limited to the particular source-code lines that are considered to infringe upon an existing patent. This would make it possible for the free software community to "write around the problem" and create a non-infringing version. The authors of the APSL apparently did not consider that patents expire. It should be possible for us to store infringing code for restoral to use upon the expiration of the patent in question. Apple might also consider if it's possible to allow third-parties to defend the disputed code from an infringement claim that would cause us all to lose our rights under the APSL.

Analyse de la licence

La licence APSL est une licence de type copyleft standard, calqué sur celui de la Mozilla Public License : tout fichier contenant du code sous APSL doit lui-même être licencié sous cette même licence.

La licence se distingue par sa définition par son application plus contraignante que les licences habituelles. En effet, la licence remplace le terme de distribution par celui d'« Externally Deployed » qui englobe toute communication, ou utilisation par réseau, à une autre personne (appréhension se rapprochant du critère d'external deployement de l'OSL.

Les brevets sont sujets à licence calquée sur celle du copyright afin de garantir une entière liberté aux logiciels soumis à la licence.

Une terminaison automatique de la licence (autant en ce qui concerne le copyright que les droits sur les brevets) est prévue dans de nombreuses situations, notamment en cas de non-respect des termes par le licencié, mais aussi en cas d'engagement de procès contre la firme Apple.

Compatibilité de la licence

Munie d'un copyleft standard, la licence APSL est incompatible avec toute autre licence, néanmoins, toute licence permissive – type BSD, MIT, etc. - semble permettre une telle compatibilité.
